An historic property and partition judgment sold at a Florida land auction near Jacksonville during the summer of 2010. High standards were set before the land auction. Bidders received strict advance guidelines, rules, terms, and conditions, including instructions handed down by the 4th Judicial Circuit Court in Clay County. Located in Orange Park on Kingsley Avenue, the parcel became part of the Annie Filmore Estate in 1890. The sale relieves almost 100 years of a long partition suit between the family and heirs of the Filmore Estate. The saga went on and on and the 120-year-old estate resisted settlement.
Clay County Taxes became part of the issue. Finally, in August 2006, the court ordered a judgment of partition, instructing that the property be sold through traditional marketing. Nonetheless, a buyer could not be found.
The seller then contacted The United Country auctioneers to market the property. A buyer came forward at auction in January 2009 but maneuvered the system to delay closing. The buyer was relieved of obligations.
The tax certificate was sold in early 2010; the holder applied for a tax deed, and the Tax Deed sale was scheduled for July 2010. In the meantime, the topic of selling the property by land auction came up during some of the several court hearings.
On June 1, 2010, the court once again ordered the sale of the property--this time through land auction marketing with very strict guidelines. For example, bidders were required to pay cash within 48 hours of the auction. Buyers were also required to pay advertising, attorney fees, a minimum bid for the partition judgment and property with all title defects and a buyer's premium added to the total. Buyers knew that they were required to close the sale within five days of the acceptance of the courts.
